1. Acceptance of Terms

By downloading, installing, or using the Kelmet mobile application, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the app.

2. Service Description

2.1 General Purpose

Kelmet is a language learning application designed to teach Maltese to French speakers, with a focus on:

• Structured lessons and courses
• Interactive exercises (multiple choice, flashcards, pronunciation, etc.)
• AI-powered feedback and analysis
• Vocabulary training and spaced repetition
• Professional and practical language instruction

2.2 Target Audience

• Expatriates and tourists in Malta
• Professionals in healthcare, hospitality, and commerce
• Anyone interested in learning Maltese
• Minimum age: 13 years old

3. User Accounts

3.1 Account Creation - MANDATORY

Registration Methods

You can create an account using one of three methods:

1. Google Sign-In (Recommended)
   • Quick and secure authentication
   • We receive: email address, name, profile picture (with your permission)
   • No password to remember
   • Email already verified - can make purchases immediately
2. Apple Sign-In (Recommended)
   • Privacy-focused authentication
   • We receive: email (or Apple's private relay email), optional name
   • No password to remember
   • Email already verified - can make purchases immediately
3. Email + Password
   • Traditional registration method
   • You provide: email address, username, secure password
   • Email verification required for purchases (not for using the app)

What Happens After Registration

• You immediately receive 20 free IA Credits
• You gain access to the "Lesson of the Day"
• You can start using basic exercises
• Your learning progress begins to be tracked
• No payment or credit card required

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials (for email sign-up)
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Email Verification

For Google Sign-In and Apple Sign-In:

• Your email is already verified by Google/Apple
• No additional verification needed for purchases
• You can immediately make purchases if you wish

For Email + Password Registration:

• Email verification is NOT required to use the app
• Email verification is NOT required to use your 20 free IA Credits
• Email verification IS required before making purchases (subscriptions or credit packs)
• You will receive a verification link by email after registration
• Simply click the link to verify your email

Why Email Verification for Purchases?

• Protects your account from unauthorized purchases
• Ensures you receive purchase confirmations and receipts
• Complies with Apple App Store guidelines
• Prevents accidental charges to wrong email addresses

What You Can Do Without Email Verification:

• Use the entire Free plan (Lesson of the Day, basic exercises)
• Use your 20 free IA Credits
• Complete lessons and track your progress
• Access all free features

What Requires Email Verification:

• Subscribing to Essential or Boost plans
• Purchasing IA Credit packs (100 or 500 credits)

• 20 free IA Credits at sign-up (one-time gift, no expiration)

• Option to purchase IA Credit packs

Essential Plan (4,90 € / month)

• Access to ALL lessons
• Vocabulary revision module
• "Coffee Break" exercises for all lessons
• Access to AI Bonus exercises
• 500 IA Credits per month (recurring)
• Personalized AI feedback
• 20% discount on IA Credit packs
• Plus: You keep your initial 20 free credits forever

Boost Plan (12,90 € / month)

• Everything in Essential
• 1,500 IA Credits per month (recurring)
• Ideal for intensive practice
• 50% discount on IA Credit packs
• Accelerated progression
• Plus: You keep your initial 20 free credits forever

4.2 Billing and Renewal

• Subscriptions are billed monthly through Apple's In-App Purchase system
• Automatic renewal unless canceled at least 24 hours before the end of the current period
• Renewal charge occurs within 24 hours prior to the end of the current period

4.3 Managing Subscriptions

You can manage or cancel your subscription at any time:

1. Open iPhone/iPad Settings
2. Tap your Apple ID at the top
3. Select Subscriptions
4. Choose Kelmet and modify or cancel

Cancellation takes effect at the end of the current billing period. No refunds for partial months.

5. IA Credits (Consumable Purchases)

5.1 What are IA Credits?

IA Credits are consumable tokens that allow you to:

• Receive AI-powered feedback on pronunciation
• Get detailed grammar and vocabulary corrections
• Practice conversation with AI role-play scenarios

5.2 Credit Packs

Base prices (Free plan):

• 100 IA Credits: 2,90 €
• 500 IA Credits: 9,90 €

Subscriber discounts:

• Essential plan: -20% discount
• Boost plan: -50% discount

5.3 Credit Usage

1 IA Credit = 1 AI feedback analysis

Exercises that consume credits:

1. Pronunciation exercises: 1 credit per pronunciation feedback (score + advice)
2. Image description: 1 credit per AI evaluation (score + correction + analysis)
3. Open question responses: 1 credit per AI evaluation (score + correction + analysis)
4. Role-play conversations: 1 credit per user message (AI correction provided). Up to 8 exchanges per role-play. Final summary is FREE

5.4 Credit Validity

• IA Credits do NOT expire as long as your account is active
• Free credits remain valid indefinitely (no expiration)
• If you cancel your subscription:
  • Purchased credits remain valid indefinitely
  • Monthly subscription credits remain valid for 90 days after cancellation
  • Initial 20 free credits remain valid
• Credits are cumulative: Free + Monthly + Purchased all add up
• Unused credits cannot be refunded or exchanged for cash

5.5 No Refunds for Consumables

6. AI-Powered Features

6.1 Audio Processing

For pronunciation exercises:

• Your audio recordings are temporarily processed by Microsoft Azure Speech-to-Text
• Audio files are NOT permanently stored
• Audio is immediately deleted after conversion to text
• Only text transcriptions are retained for your exercise history

6.2 AI Analysis

• All AI feedback is powered by Google Gemini AI
• Gemini analyzes your text responses, descriptions, and transcriptions
• Provides personalized corrections, scores, and learning advice

7. Refund Policy

7.1 Apple's Refund Policy

All purchases are processed through Apple's In-App Purchase system. Refund requests must be made directly to Apple:

1. Go to reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find the Kelmet purchase
4. Select "Request a Refund"

7.2 Our Refund Policy

• Subscriptions: No refunds for partial months or unused subscription time
• IA Credits: No refunds for consumable purchases once credits are used
• Free Credits: No refund applies (no payment involved)
• Exceptions: Technical errors causing incorrect charges (contact support)

8. Acceptable Use

You agree NOT to:

• Use the app for any illegal purpose
• Attempt to hack, disrupt, or damage the service
• Share your account credentials with others
• Create multiple accounts to abuse free credits, free trials, or promotions
• Use bots or automated tools to interact with the app

Violation may result in account suspension or termination without refund.

9. Limitation of Liability

To the maximum extent permitted by law:

• Kelmet is not liable for any indirect, incidental, or consequential damages
• We are not liable for data loss, service interruptions, or technical errors
• Our total liability is limited to the amount you paid in the last 12 months

10. Governing Law

These Terms are governed by the laws of Malta. Any disputes shall be resolved in the courts of Malta.
